Version dated 17 September 2026 — Sale of automotive parts and accessories · Français
This English translation is provided for information. If it differs from the French version, the French version prevails, subject to any mandatory rights applicable to the consumer.
1. Seller and scope
The seller is François GAYON, sole trader operating as a French micro-enterprise under the trading name Cosmick Tech, SIREN 828 123 620, SIRET 828 123 620 00027, registered with the Toulouse Trade and Companies Register, 1955 route de Cambernard, 31470 Sainte-Foy-de-Peyrolières, France. Contact and after-sales service: s62labcontact@gmail.com; non-premium-rate telephone: +33 9 50 02 24 92.
These Terms of Sale apply exclusively to physical goods purchased from S62 SHOP. VANOS LAB licences are governed by their own Terms of Sale and DIAGLAB by its Terms of Use. The customer declares that they have the legal capacity to enter into a contract. Mandatory rights granted to consumers and non-professionals remain applicable.
2. Products, compatibility and installation
The characteristics, quantities, variants, prices, new or used condition and usage restrictions are stated on each product page. The customer must check part numbers and compatibility with the vehicle and seek advice before ordering if in doubt. Photographs illustrate the products and do not permit the delivery of a product differing from the agreed characteristics.
Unless expressly stated otherwise, the price does not include installation, adjustment or diagnosis. Installation must comply with the technical instructions, tightening torques, safety rules and conditions of use specified by the manufacturer and the product supplier. The use of a qualified professional is strongly recommended, particularly for wheels and engine work. Do not install a product showing an anomaly; contact the seller.
No approval for road use or authorisation to modify the vehicle is presumed. Any applicable restrictions must be stated on the product page before purchase. The customer must comply with the approval, road traffic and insurance rules applicable to their use. This does not release the seller from its duties to provide information and conforming goods.
3. Prices and orders
Prices are stated in euros. VAT is not applicable under Article 293 B of the French General Tax Code, under the tax scheme declared by the seller. The proposed delivery and insurance costs are added and displayed before payment. No optional surcharge is added without consent. For delivery outside the relevant tax territory, customs duties, import taxes and clearance fees may be charged to the recipient by the authorities or carrier; their amount depends on the destination and is not included where it cannot be calculated in advance.
The customer checks the basket, selected variant, contact details and total, may correct any errors, then accepts these Terms and confirms an order carrying an obligation to pay. Payment is processed by Stripe; the seller does not retain complete card details. The order is confirmed after payment approval and a summary email is sent. Orders marked TEST in the development environment result in neither a real charge nor real shipment.
Products are offered subject to availability. If a product becomes unavailable after payment, the seller informs the customer and refunds the unavailable product; no substitution is imposed. Later versions of these Terms do not amend an order already concluded. A copy of the contract may be requested from the seller; electronic contracts worth at least €120 are retained for the statutory ten-year period in accordance with the rules applicable to delivery.
4. Delivery and risk
Available destinations depend on each product: wheels are limited to Europe; other products may be delivered to countries offered during checkout, subject to carrier availability. Wheels are shipped in four parcels; other products are combined where possible. The customer selects an available service and, where applicable, a pickup point.
Unless a different period is expressly agreed before the order, delivery takes place no later than thirty days after conclusion of the contract. A carrier estimate does not remove this commitment. In the event of delay, consumers may exercise the rights provided by Articles L. 216-6 et seq. of the French Consumer Code, including requiring delivery within an additional reasonable period and then terminating the contract, or terminating it immediately in the cases provided by law. Refunds are made within fourteen days after termination.
For consumers, the risk of loss or damage transfers upon physical possession, except where the consumer chooses a carrier not offered by the seller under the conditions laid down by law. Transport insurance neither replaces nor limits the seller’s obligations. Check parcels and promptly report any anomaly, with photographs where possible; the absence of reservations made to the carrier does not remove the customer’s rights against the seller.
An incorrect address or an uncollected parcel must be reported promptly. Any reshipment attributable to the customer is subject to agreement on the actual costs, without a fixed penalty. Simply refusing or failing to collect a parcel does not in itself constitute notice of withdrawal.
5. Withdrawal and returns
A consumer has fourteen days to give notice of withdrawal without stating a reason, starting on the day after receiving the goods. Where several goods from one order are delivered separately, or goods are delivered in several lots or parts, the period starts upon receipt of the last good, lot or part. If the final day falls on a Saturday, Sunday, public holiday or non-working day, the period is extended to the next working day.
The decision may be submitted using the “Withdraw from the contract” form, by email to s62labcontact@gmail.com or by post to the seller’s address, using the model form below or any other unambiguous statement. A return number or prior authorisation is not a condition of this right. An online declaration is acknowledged on a durable medium.
The goods must be returned to the seller’s address no later than fourteen days after notice is given. Direct return costs are borne by the customer, except in the event of a seller error or a statutory guarantee claim. Use protective packaging and return all supplied accessories. The original packaging is recommended but is not a condition of the right of withdrawal. Keep proof of return. If a product cannot normally be returned by post, an estimate of the return cost must be provided before the order.
When the whole order is withdrawn, the seller refunds all sums paid, including standard delivery costs, without any supplement relating to a more expensive method selected by the customer. The refund is made using the original payment method unless another fee-free method is expressly agreed, no later than fourteen days after notice. It may be withheld until the goods are recovered or proof of dispatch is received, whichever occurs first. For a partial return, costs relating to the retained goods remain payable.
Installed, connected or used product: installation does not automatically remove the right of withdrawal. The consumer may, however, be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods. Installation marks, scratches, drilling, soldering, modifications, contamination or road use may therefore justify a deduction corresponding to the actual, demonstrable loss of value. No fixed restocking fee or automatic refusal is applied solely because of installation. Any deduction is explained and substantiated.
The statutory exception for goods made to the consumer’s specifications or clearly personalised applies only where those requirements are genuinely met and disclosed before purchase; choosing a standard colour or variant is insufficient. For a strictly professional purchase, no contractual convenience-return right is granted, subject to any applicable statutory provisions.

6. Statutory guarantees
The seller identified in Section 1 is responsible for the statutory guarantee of conformity and the guarantee against hidden defects. Contact the seller with the order reference and a description of the defect. No additional commercial warranty is granted unless expressly stated on the product page. Installation by the customer does not in itself remove statutory guarantees. They do not cover damage caused by incorrect installation, modification, unsuitable use or normal wear, without reversing statutory rules of evidence or excluding a defect for which the seller is responsible.
Statutory notice — appendix to Article D. 211-2 of the French Consumer Code
The consumer has two years from delivery of the goods to obtain implementation of the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the scheduled supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or service and not the date on which it appeared.
The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the statutory guarantee of conformity, the consumer receives a six-month extension of the original guarantee.
If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the replacement date.
The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1. The professional refuses to repair or replace the goods;
2. Repair or replacement takes place after thirty days;
3. Repair or replacement causes major inconvenience to the consumer, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or the cost of installing repaired or replacement goods;
4. The lack of conformity persists despite an unsuccessful attempt by the seller to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is sufficiently serious to justify immediate price reduction or termination. The consumer is then not required to request repair or replacement beforehand.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until delivery of the restored goods.
The rights set out above arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained or a full refund in exchange for returning the goods.
For second-hand goods, a defect is presumed to have existed at delivery for twelve months, without reducing the two-year duration of the statutory guarantee of conformity.
7. Liability
The seller is responsible for its statutory and contractual obligations. It is not liable for damage it proves was caused exclusively by customer fault, use contrary to instructions or an external cause meeting the statutory requirements. The customer remains responsible for their own installation operations and technical choices; this does not release the seller from liability for a defective product, incorrect advice or insufficient information.
Foreseeable and direct damage is assessed under the applicable law. Nothing excludes statutory guarantees, product liability, personal injury, gross negligence or wilful misconduct. No fixed compensation cap is enforceable against a consumer. Force majeure is assessed under Article 1218 of the French Civil Code; a carrier delay alone is insufficient to constitute force majeure.
8. Data, complaints and governing law
Data is used to process orders, payments, delivery, notifications, returns and legal obligations. Relevant service providers include Stripe, Sendcloud, carriers and Gmail for email delivery. Information and rights are described in the privacy policy. The tracking link is personal and must be kept confidential.
Complaints may be sent to s62labcontact@gmail.com or to the seller’s postal address. These Terms are governed by French law without depriving consumers of the mandatory protections of their country of residence applicable to the order. The competent courts are those designated by law. If one provision is invalid, the remaining applicable provisions continue in effect.
